View Full Version : Spanish Court Dismisses File-sharing Appeal

Some (Finally) Good news.

A Spanish court has dismissed an appeal against a file-sharing site with a ruling that may be one of the most severe legal defeats for the entertainment industry in its fight against copyright infringers.

The Web site, cvcdgo.com, linked to content that had been posted on peer-to-peer file-sharing networks without permission of the copyright holders.

In May 2009 a Madrid court dismissed the case, which was brought by Egeda, an audiovisual collection society, along with Columbia Tristar. An appeal was dismissed by the court last week.

The court found that the Web site did not store the content and that it linked to files that "are found in different computers around the world," according to the Spanish-language ruling.

The three-judge panel also found that "no one receives any type of economic benefit" from linking to the content, although the site did have advertising.

In other countries such as the U.S., defendants can be found guilty of inducing infringement even if their sites only contain links that lead to content shared without proper permission.

An official reached at Egeda did not have an immediate comment on the ruling.

As you said, finally a good news!

We are currently (in Canada) facing challenges in that area as the lawyer says that Canada is considered as a "pirate refuge"... At my opinion, the best thing about file sharing, is that information is now accessible to a lot of people, without considering political opinions, revenues or races... i now listen to some New-Zealand groups of music that I never would have heard about without internet. Some artists can show their work to the whole world! It's the perfect example of pure democracy.

I remember when they commercialized the VCR... They were telling people that video recorders will lead the cinema industry to bankruptcy... I guess that it did not happen. So why is that different from file sharing?

I will always take the side of liberty. Again, my opinion :grin:

I agree, I think its a matter of how you look at file sharing that ends up dictating how the future would look.

I have been living in US for over 10 years now, but the file sharing community made it possible for me to keep in touch and be involved culturally with the things that goes on at home, so even though I am pretty sure its not on their list of goals, those communities keeps giving me a taste of home :)

I think (well I hope) the internet did amazing things for spreading knowledge and culture once you let go off stupid copy rights claims people are exposed to amazing things, Project Gutenberg is exposing people to literature masterpieces, without a knowlage sharing community the work of most of those people would have died long time ago.

So true! It allows us to learn about other cultures and other people around the world. You can have access to a lot of different stuff, from every point of view. Not the tinted vision of all the medias, controlled by a very tiny, elite community... It's so good to find diversity! I hope that this spread of knowledge will continue for years and years...:unsure:

I am really hoping other countries would follow in their footsteps, It will be nice to be treated like a community as appose to a pack the thieves LOL
